Obamacare’s Problems

March 23 will become the 10th anniversary of the passing of the Obamacare legislation. And while America briefly flirted with it in terms of the likeability, it’s been a terrible piece of legislation that has hampered millions of Americans from actually getting individual healthcare insurance for the past several years.

There is no movement in Washington to fix the problems that its’ caused, nor to address the one good thing that it did for healthcare…get rid of pre-existing conditions. Some 43% of households in America have someone living there that has a pre-existing condition, and unless they or someone in their immediate family are working, they are forced to go on Obamacare in order to avoid that pitfall.

The problem facing Obamacare, and it will for the third time in ten years be going up in front of the Supreme Court again in the next few months, is that America doesn’t like it. It had a brief instance where acceptance reached about 55-60%, but has retreated to where about half the country hates it and half the country will tolerate it. And as you would guess, it’s pretty much along party lines.

Democrats are overwhelmingly in favor of it because they feel it gives underprivileged people the chance to get “reasonably priced” healthcare because of the government subsidies. Most independents and conservatives hate it because of the bite it gives if you happen to make too much money that year. You’re then billed for the overage at over-inflated rates. Now, the bite has been taken out of the bill since the IRS, which has to administer the penalties can only withhold your tax refund…so if you don’t get a tax refund, and actually owe money to the IRS come April, they really can’t hold it against you. Still, it scares most people to be going up against Uncle Sam.

Congress needs to put this impeachment thing on the back burner and fix this abortion. Better yet, what they need to do is to keep the pre-existing condition clause and make that federal law. That’s going to raise premiums, yes, but will also guarantee coverage to everyone. Then allow people to buy insurance across state lines, so that competition will be stronger. You don’t need to make people buy healthcare if you give them a good enough reason to buy it. And if you don’t allow people to escape paying their medical bills, that’s one way to get them back in the insurance pool.

Congress also needs to address the high cost of prescription drugs, and the high cost of hospital visits and the like. To receive a bill for $100,000 for a two night stay in the hospital would sink probably 98% of Americans! If we get medical costs in line with the rest of society, it goes a long way toward helping solve the medical crisis in this country.

Socialized medicine may work in Norway or Canada where they have fewer people than live in California. It won’t work here. We’re too big, and too impatient. I can’t see people waiting six months to have a hang nail removed. And do you have any idea what happens if you wait six months to see an oncologist? You won’t be seeing an oncologist…that’s what happens!

Incrementalism At It’s Finest

The leftist snowflakes out there never cease to amaze me. They go crazy with their incrementalism. The first time I actually remember it was back in the 1960’s. They decided it was a good idea to put seat belts in cars because it would lower traffic accident deaths. Of course, it was a good idea…but they sold it to the American public by saying that it wasn’t going to be a law. They were just going to be in the car as a safety feature. We HOPE you use them, but we’re not going to MAKE you use them.

Then of course, they decided a few years later that they could give you a ticket if they pulled you over for another offense, but they couldn’t pull you over just for not wearing your seat belt. Then they changed the name to “safety belt”. And finally a few years later, they started withholding money to states that didn’t have a seatbelt, er, safety belt law in place. Now, pretty much everywhere it’s against the law to not wear a seat belt.

Well, they’re at it again. This time with Obamacare! Yes…that abortion of a healthcare bill where if you loved your doctor, you probably lost your doctor. And you never saw that $2,500 per family savings you were promised, right? There is a provision in Obamacare called “Section 1332”. It basically says that states have the right to apply for waivers to Obamacare. Twelve states have done so, and not all of them are conservative states either. Colorado, Delaware, and Rhode Island have all applied for and received waivers from the federal government not to enforce certain parts of the Obamacare law.

Because of these waivers, seven states have lowered healthcare premiums under Obamacare by 7.5% since Donald Trump took office. But now Dems want to take that ability of states to ask for waivers away. It won’t pass the Senate, and it won’t be signed by Trump, but it’s amazing that they are out there still fighting for a law that is about to be declared unconstitutional in the next nine months by the US Supreme Court!

I wonder what they’re going to do at that point? If they are too busy impeaching the president, and not doing the public’s work, aren’t they going to be too busy to tackle something so mundane as fixing a healthcare law that is unconstitutional? After all, Congress hasn’t done squat to tackle the opioid crisis. They haven’t done anything to stem the flow of illegal aliens at the southern border. They haven’t fixed the broken down immigration system. They haven’t been able to fix Medicare or Social Security since it’s inception some 80 years ago (for social security). What makes us think they can actually do anything with healthcare?

Until we get rid of liberal snowflakes with socialistic agendas that fly in the face of the Constitution, we are never going to have a Congress that is able to write and pass laws the American people need. Democrats need to be removed from office in any way possible!

Going Down The Rabbit Hole

Have you ever really taken a good hard look at this evolving issue called “climate change”? Have you seen where the roots are, what the real true goals of the left are, and how it will effect your life? Are you aware that the evolving debate is tied directly to Obamacare? Actually, all of that is pretty obvious once you look at it. Let’s get into it.

The roots of “climate change” can actually be traced back to Lady Bird Johnson. Back in the 60’s, First Ladies all had some sort of program they wanted to push. Maybe it was literacy, maybe it was being a better wife back then…whatever it was, they all had some sort of issue they wanted to help promote. Lady Bird Johnson’s was pollution. She was concerned that we were spewing a lot of pollution, not only from factories, but throwing trash out of cars. Yeah…I know…it’s not nearly the big issue today that it was fifty or sixty years ago. Do you remember the Public Service Announcement of the Native American (called an Indian back then), that was standing on the side of the road, and someone threw a bag of trash at his feet, and you saw a tear roll down his cheek? That was the start.

Since then, we’ve seen the incrementalism that only the snowflake leftists can produce. Now, I’m not saying that pollution isn’t bad…of course it is. But this isn’t about stopping pollution any more than what these folks are screaming about today is about the climate. It’s about power. That’s the real goal of the left. They want to get as much power from you as they can so they can control you.

That’s the push for all of the socialist agendas. Get all of the programs under one roof, all controlled by the government. And, when it comes to climate change, they can tell you exactly when you can and cannot drive…when you can fly to Walt Disney World with the family…when you have to walk…because one of the big rules that Saul Alinsky wrote, and basically he took it right from Karl Marx is that if you restrict movement of the masses, it’s easier to control them. If the left can get you to not move about the country so much, you’re easier to control.

Likewise, they want you to stop eating beef. Why? Is beef bad for you? No…they say it’s because cows fart. So, we must kill off all of the cows. In doing so, they are controlling what you eat. And they basically won’t kill off cows, they’ll just get a tax imposed on anything made with beef that’s so high that it’s restrictive. You won’t be able to afford it, or if you are, it will become a once in a while thing, not a daily thing.

So what does “climate change” have to do with Obamacare? Simple. Follow the money. When Obamacare became law, it was step one in the incrementalism designed to make single-payer healthcare a reality. Obamacare was never intended to succeed. It never went far enough. It was meant to fail, and then the leftists could come in and “fix it” by making your healthcare decisions for you. Remember what Hillary Clinton tried to do in 1992 when she tried to pass her healthcare bill? She took too big a bite and it got defeated. Obamcare was the fix to that. And now that it’s failed, Dems want to “fix” it by giving us “Medicare for all”, which is single payer healthcare. Unfortunately that doesn’t work on this scale either…but they don’t care. They are doing it to control 18% of the country’s economy. Now throw in all of the taxes and fees that a Green New Deal will impose, and you’re soon going to be giving them half of your salary, even before you pay your income tax. Now, you not only are restricted in diet and travel, you have no money and have to rely on the government for everything.

THAT is the goal. THAT is why it needs to be stopped. THAT is why they are pushing so hard to get it through. And the dumbed-down youth of today are buying it because our schools have stopped teaching basic common sense.

We Don’t Need No Stinkin’ Court Ruling!

So, yesterday, they heard arguments at the 5th Circuit Court of Appeals in New Orleans as to whether the Appeals Court should uphold the lower court decision to make Obamacare unconstitutional. Based on the Supreme Court’s ruling way back when John Roberts sided with the liberals and said Congress could tax anybody for any reason, it should be declared unconstitutional. But if it is, the snowflakes will scream that millions will be left without healthcare.

Of course, that’s a lie.

Actually, they should have screamed when Obamacare went into effect. More people lost their healthcare than actually got healthcare through Obamacare, and yet the leftist snowflakes were amazingly silent.

So, to help mankind, I’m going to once again tell people how the whole healthcare situation needs to play out. It’s a simple plan really. And it’s one that’s based on common sense, not leftist socialist policies and hopes and dreams.

First of all, you wipe Obamacare off the face of the earth. It was a terrible idea. OK, not completely terrible. It did allow the pre-existing condition clause to be swept away, which was a good thing. It also did away with the million dollar lifetime maximum. That was another good thing. Other than that, there wasn’t a lot of good in the bill.

Next up you allow insurance companies to sell insurance across state lines. That does a couple of things. It allows the playing field to be much larger, thus, the competition will drive the costs down. And you can shop around each year for the lowest priced policy.

Does everyone have to have insurance? Yes. You must have some sort of insurance, but that’s based on your desire and your needs, not on what the government tells you that you have to have. So, if all you want is to have critical care insurance (typically very inexpensive), that’s fine. If you don’t have to have pregnancy insurance, because you happen to be 85 years old, or a male, or you’ve had your tubes tied, you don’t have to buy that option. You buy whatever types of coverage you want.

Maybe you want to pay your primary care physician out of pocket and save your insurance in case something bad happens and you’re hospitalized. Maybe you never want to see a medical bill. Maybe you want drug coverage. Maybe you want ambulance coverage. Whatever you want you are able to pick and choose cafeteria style. By the way, it’s the same way you are able to buy your car insurance and your homeowners’ insurance today.

Now, when you go to the emergency room, you have to show an insurance card. If you don’t, they can stabilize you and send you on your way, but they don’t have to admit you. If you’re an illegal alien, you aren’t covered, so you don’t get hospitalization. If you as an illegal want to pay for a doctor’s visit out of pocket, that’s fine, but a trip to the hospital requires insurance.

If you want a Health Savings Account (pre-tax), you can certainly set one up. Oh, and all hospitals, and all doctors, and all pharmacies, and all ambulance companies have to accept all insurance. And yes, Virginia, if you are covered for an illness, your insurance company HAS to pay for that illness. No ifs, ands, or buts. If they don’t, you CAN sue them.

There you go. Now, the leftist snowflakes will complain that it does nothing for the poor. It does, actually. It allows the poor to purchase cheap insurance. You don’t have a right to eat, or to live in a house in this country, and you don’t have a right to expensive medical care either. That’s just the way the cookie crumbles. If you can’t afford a couple hundred dollars a year for critical care insurance, you probably have more serious problems than your health!

And there you go, America. Healthcare is solved. Free of charge, free of government interference. Free market saves the day. There’s no need to thank me. It’s my gift to mankind.

Obamacare Heads To Appeals Court

Well, you know it had to happen, right? Obamacare, that abortion of a healthcare takeover by the federal government, who really never wanted it to succeed, but fail so it could be replaced by single-payer healthcare (read that as socialized medicine), is heading to the 5th U.S. Circuit Court of Appeals in New Orleans. There, a panel of three judges will decide whether or not to uphold the Texas Federal District Judge’s decision that since there was no more individual mandate tied to Obamacare, it basically struck the entire law down as unconstitutional.

Democrat Attorneys Generals from around the country, as well as the House of Representatives are the plaintiffs in this case, arguing that the law is still constitutional. And, they’ll have an uphill battle because of the path that had to be chosen.

In New Orleans, two of the three justices that will hear the case on Tuesday, were appointed by Republicans. One was appointed by a Democrat. Regardless which side prevails in that particular step, the losing side will most assuredly appeal the decision to the United States Supreme Court who would hear the case sometime next year, and would end up either deciding the constitutionality of it once and for all, or they would decide not to hear the case and let the lower appeals court ruling stand. If the majority view matches the 5th Circuit’s view, my hunch is, they’ll pass on hearing it and let the lower court ruling stand.

Let’s play the scenario that most people think will happen. The 5th Circuit decides it’s constitutional based on John Roberts’ argument that the individual mandate was indeed a tax, and that Congress has the right to tax people. Now that there is no individual mandate, there is no “tax” on the people, and therefore, there’s no reason to keep it constitutional. That would allow individual insurance companies to get back into the individual marketplace, and we’d get back to normal. Hopefully, Congress would feel like they actually owed the American public something after the debacle they foisted on us a decade ago (yes…it was that long ago!). And they’d allow us to buy insurance across state lines. That would make this very appealing to say the least!

Let’s hope and pray that finally, the nightmare will be over, and we can at long last erase the last legacy item of the idiot that is Barack Obama.

DOJ To High Court: Throw Out ALL Of Obamacare!

It was announced last week that the Department of Justice will no longer support in court, nor prosecute people not signing up for Obamacare. In effect, the announcement came as a Texas Federal Judge threw out the over-bloated law as unconstitutional, and most certainly is working it’s way through the courts.

The main reason Obamacare was found to actually BE constitutional back in 2011 was because Supreme Court Chief Justice John Roberts, who wrote the majority opinion said that Congress has a right to tax people, and Obamacare was actually a tax on people that chose not to buy healthcare insurance. That was because of the “individual mandate” that basically would charge you an increasing amount of penalty if you didn’t provide healthcare for yourself for at least 9 months of the year.

When the Republicans sent a budget bill to Donald Trump early on in his presidency, it included a part that gutted the individual mandate. Federal Judge, Reed O’Connor took Roberts up on his ruling stating that since the individual mandate was no longer in effect, the whole law was unconstitutional…and should be gutted.

The most recent announcement coming out of the DOJ is that they will side with the 26 states that have fought this notion that Obamacare was a good thing. Instead, they would like to see the whole thing gutted. And now, it appears it will be. At least that’s the theory behind it.

If John Roberts’ view was that Obamacare was actually legal because it was viewed as a tax, and Congress has the right to pass taxes, that would negate the bill in it’s current form, because there is no tax. And you can’t force people to buy something they don’t want to buy. So, unless Congress decides to pass it as another tax…highly unlikely in this partisan environment…it looks like Obamacare is not only on life support…it looks like Obamacare could very well be a thing of the past.

Now, Democrats will scream that “millions” of people will be without healthcare if this fails. Actually, like the Russian Collusion story, and the Obstruction of Justice story, this is a lie. What will happen is the individual market will open back up again and thrive, as it did prior to 2010. And that means maybe we can FINALLY get rid of this abortion of a bill known as Obamacare once and for all. We can FINALLY dump that idiocy of a health care test known as socialized medicine that hasn’t worked, and caused pain. As for the “millions” of people that are on the rolls, actually the number is closer to 1.5 million. That’s not “millions”. The others that are on the rolls were forced to be there because they were on an individual insurance plan that got taken away by Obamacare.

And by the way…on that account, there is no argument. I was one of those people. It’s true what happened. And for me to get on Obamacare here in the desert (along with my wife) will cost upwards of $2,700 a month for a crappy insurance plan that very few doctors and hospitals accept. The out of pocket deductible is $6,000 per person, and the maximum is $17,000! So I get the “right” to pay almost $3,000 a month to build up to a $6,000 deductible? Yeah…that was a real smart bill!

There’s only one thing to say about this abortion…Thanks Obama!

US Healthcare “Sucks”

When I started writing the original blog titled “Desert Musings” about five years ago (I really lose track of time out here!), it was because of the healthcare situation. Obamacare was coming into it’s own, and the rollout was, and I’m being polite here, less than admirable. I’ve written on healthcare many times since then, and the abortion that has become known as Obamacare. According to the folks at Gallup, they’ve been asking the question on the state of our healthcare for 25 years now, and only once has it not sucked in the eyes of Americans…right after 9/11.

Typically, according to Gallup, the range of people saying that our healthcare is “in crisis” has ranged between 64 and 73%. Today it’s a 70%. It dipped to 67% when Obamacare came into existence, then rose back up to 73% the next year. The dirty little secret is that 84% of Democrats think Obamacare sucks! Obviously, Obamacare isn’t the solution.

The question I have is, why aren’t Democrats rushing to fix it? They are the ones that demanded it;told us we’d love it; clamored for it; fought for it not once, but twice in the Supreme Court. And all that time, we’ve hated it. It cost them the House of Representatives back in 2010, and it’s something that cost them the House for a total of 8 years!

You would have thought that something that bad would be fixed. Ah, but there’s the rub! It isn’t bad in Democrats’ eyes. Even though a vast majority of Americans (including Democrats) view our healthcare system as “in crisis”, they feel it should be saved. Why? Because it takes power from you and me and gives it to the federal government. When Obamacare was instituted, one-sixth of the US economy switched from our hands and our employers’ hands to the government’s hand. That is the real reason Democrats are fighting to keep it in government hands.

Let me use a parallel argument to show you my point. Let’s look at Social Security. Why do you think the government doesn’t want it privatized and allow you to invest your Social Security account in the stock market? Now, they say it’s because it’s too risky, right? Yet, every single American that’s employed and has a 401k has money in the stock market, most likely in the form of mutual funds. The wealthiest men and women in America ALL have money in the stock market. So, if they can get rich playing stocks, why wouldn’t the Democrats want you to do the same thing? The answer is control and power. They lose it, you get it.

And if you have control and power, you realize that you don’t need them. You don’t need all of the government cradle to grave programs to take care of you. And if you don’t need those programs, you don’t need liberalism. And then they cease to exist as a power and a party because we’ve once again proven that liberalism doesn’t work. They can’t have that!

So, when it comes to fixing our healthcare system, I can do it in one paragraph. Buy it across state lines, from anyone you choose; make every hospital, lab, and doctor accept all insurance; and buy it like you do car insurance. You have to have a minimum amount, but you choose the rest.

Gee, I solved healthcare in basically two sentences. And it took Democrats over 1,500 pages to write the Obamacare law! And they think they’re the smart ones in the room?
